In California, the State Lottery withheld winnings from unclaimed property to pay back overpayment debts. Unclaimed property is uncashed checks, money orders, life insurance benefits, inactive bank accounts, stock dividends, and other forms of property that have not yet been claimed. Under Government Code Section (SS) 12419.5, the Controller may offset the amount of winnings with amounts due to state agencies. This action was challenged by the winner.
